Santa Monica Personal Injury Attorney

Ten years was the window Santa Monica gave itself in 2016 to bring traffic deaths and serious injuries to zero. In a September 2026 staff report, the city acknowledged that it had missed that goal: serious and fatal crashes rose from 29 in 2021 to 62 in 2024 (City of Santa Monica). The questions below are the ones a Santa Monica personal injury attorney hears most often, and the answers draw on that report and on the state’s crash rankings rather than on general advice.

At a glance — Santa Monica

  • 214 fatal or severe-injury crashes from 2021 through 2025
  • 77 of them involved pedestrians and 31 involved cyclists
  • Ocean Avenue and Santa Monica Boulevard tied for the most, with 26 each
  • The city did not meet its 2026 Vision Zero target

Jump to a question:

  1. Are Santa Monica streets getting more dangerous?
  2. Do Ocean Avenue and Pico really stand out?
  3. When a driver hits someone walking, who gets blamed?
  4. What if a Big Blue Bus hit me?
  5. Does anything change for cyclists and scooter riders?
  6. Does it matter that the driver lives elsewhere?
  7. Which police agency and courthouse handle my case?
  8. Deadlines and the terms of our representation

Are Santa Monica streets getting more dangerous?

According to the city’s own records, yes. Public Safety Department data show fatal and severe-injury (FSI) crashes rising through most of the Vision Zero period:

YearFSI crashesDeathsPedestrian FSIBicyclist FSI
202129295
2022336105
2023385156
20246252110
2025523225

Serious pedestrian crashes increased every year, from 9 to 22. Over the five years the city recorded 214 FSI crashes, and 20 of the 21 fatal crashes involved someone walking (16) or riding a bicycle (4).

The state’s figures show the same pattern. Among 103 peer cities in the 2023 Office of Traffic Safety tables, only two fared worse than Santa Monica for people on foot (62 hurt or killed), 3rd-worst again for pedestrians 65 and older (11), 6th for motorcyclists (33) and 8th for bicyclists (48) (OTS). Its all-victim total of 417, by contrast, sat at 39th. Crashes between cars are ordinary here; what stands out is the harm to people outside them.

Do Ocean Avenue and Pico really stand out?

Three corridors lead the 2021–2025 count of serious crashes, and each has its own sources of evidence:

CorridorFSI crashes, 2021–2025Worth checking
Ocean Avenue26Hotel and pier-area cameras; visiting witnesses
Santa Monica Boulevard26The 2026 quick-build left-turn and crosswalk changes at Chelsea Avenue
Pico Boulevard22Bus stop placement and turning conflicts

Wilshire Boulevard has its own safety corridor study, and Neilson Way is receiving speed tables because of its traffic volume.

One finding makes Santa Monica cases unusual: serious crashes are widely dispersed. No single intersection had more than three FSI crashes in five years; six had three and 29 had two. In a claim, then, the argument rarely rests on a notorious corner. It rests on what happened in your crash, such as the signal phase, the speed or a driver’s turn, and on patterns along corridors like those above.

Tip: The city is moving toward red-light cameras under SB 720 and automated enforcement of bus and bike lanes, so ask early whether a city camera covered your location. Cameras at hotels, restaurants and apartment buildings along Ocean Avenue and Main Street are often a better source.

When a driver hits someone walking, who gets blamed?

Usually the driver. In the 77 serious pedestrian crashes from 2021 through 2025, police found the driver at fault in 48, the pedestrian in 21 and neither party in 8. The most common driver violation was failing to yield to a pedestrian with the right-of-way (23 crashes), followed by other hazardous movements (8) and unsafe speed (7).

Those figures help when an insurer claims you “came out of nowhere.” They say nothing certain about your case, and a police conclusion does not bind a court. California applies pure comparative fault, so a pedestrian who shares some of the blame still recovers the rest (CACI 405).

A Santa Monica pedestrian accident lawyer will want the following, roughly in this order:

  • Signal timing and walk-phase records for the crossing
  • Video from storefronts, hotels or Big Blue Bus cameras
  • Contact information for witnesses, since visitors to the pier often fly home within days
  • Emergency room and follow-up records that show the full extent of the injury

Since failure to yield is the leading violation here, our pedestrian accident page spends time on how that violation is proved.

What if a Big Blue Bus hit me?

The City of Santa Monica operates Big Blue Bus (Wikipedia), and that changes the first deadline. Before any lawsuit against City Hall over a Big Blue Bus crash, a formal claim must reach the city within six months of the injury (Gov. Code §911.2).

The same six-month rule applies to:

  • a city-owned truck or maintenance vehicle;
  • a cracked city sidewalk, a dark signal or another hazard on public property;
  • the Metro E Line, whose western terminus is the Downtown Santa Monica station (Metro), and Metro’s Line 134 bus to Malibu along PCH.

Bus riders who wait past that window can forfeit the claim entirely. Our bus accident page explains the claim form and what happens after the agency responds.

Does anything change for cyclists and scooter riders?

Bicycles

Santa Monica has invested in neighborhood greenways, with Michigan Avenue the most developed and Washington Avenue a traffic-calming pilot. Even so, serious bicycle crashes doubled from 5 in 2021 to 10 in 2024, and four cyclists were killed over the five years. Our bicycle accident page explains dooring beside parked cars and right-hook turns.

E-scooters

Shared scooters have a long history here; Bird was founded in Santa Monica in September 2017 (Bird Global). If a driver hits you while you are riding a scooter, the claim proceeds against the driver’s insurance like any other crash. If the scooter itself failed, the operator and the manufacturer may be responsible, so save the rental app’s terms. Our e-scooter page covers both situations.

Does it matter that the driver lives elsewhere?

Often it does. Santa Monica’s 90,082 residents in mid-2025 (Census) are outnumbered on any weekday by the people who drive in. According to the city, 87.8% of people who commute to jobs in Santa Monica (64,541 of 73,554 workers who do not work remotely) come from elsewhere. Add visitors to the pier and the beach and a steady stream of rideshare drivers, and the driver who hit you may well be insured elsewhere or driving for Uber or Lyft at the time.

In practice, that means:

  1. Uber and Lyft: which policy applies depends on the app’s status at the moment of impact: waiting for a request, on the way to a pickup, or carrying a passenger. The rideshare accident page sets out what Uber and Lyft insure in each of those three periods.
  2. Rental cars raise their own coverage questions, and tourists may carry little personal insurance.
  3. Low-limit policies are common, so review your own uninsured and underinsured motorist coverage early.

Alcohol is also a factor. The state counted 44 people injured in alcohol-involved crashes in 2023, and 167 DUI arrests.

Which police agency and courthouse handle my case?

Santa Monica police officers report collisions from Wilshire Boulevard to Pico Boulevard and along Lincoln. On I-10 and some stretches of state highway, the report usually comes from the CHP West Los Angeles Area at 6300 Bristol Parkway in Culver City, which lists Santa Monica in its territory and describes the 405 and the 10 as among the most congested freeways in the country (CHP).

Hospitals in the city include Providence Saint John’s Health Center and UCLA Health Santa Monica Medical Center. For a critical injury, paramedics often bypass both and head to Westwood, where Ronald Reagan UCLA Medical Center holds a state-listed Level I designation (California EMSA).

Under the Superior Court’s district rules, the place of the crash determines where a case is filed, so local injury cases go to the West District courthouse at 1725 Main Street, a few blocks from the pier (LASC rules). Most injury claims settle without a trial, but the courthouse affects scheduling if a case does not.

Does the city’s missed Vision Zero target make it liable for my crash?

No. Missing a goal is a policy failure, not proof of fault. A claim against the city requires a specific dangerous condition of public property, such as a dark signal or a hidden pothole, that helped cause your injury, and it requires the six-month claim.

My flight home leaves next week. Can the case continue without me here?

No. Records requests, negotiations with insurers and most paperwork can be handled by phone, mail and email. Before you leave, photograph the scene, keep your emergency room discharge papers from Saint John’s or UCLA Santa Monica, and write down the Santa Monica police report number.

My neck felt fine on the Third Street Promenade but began to hurt two days later. Is it too late?

No. Whiplash and concussion symptoms often appear a day or more after a crash. See a doctor now and keep a record of every visit; an insurer will point to any long gap in treatment.

Deadlines and the terms of our representation

Call Jacob represents Santa Monica residents, the tens of thousands of people who commute into the city and visitors hurt near the pier. On each case we handle the Big Blue Bus or city claim, obtain the Santa Monica police or CHP West Los Angeles report and address where the case would be filed in the West District. Our Santa Monica cases include crosswalk and bicycle crashes on Ocean Avenue, Pico Boulevard and Santa Monica Boulevard, e-scooter falls, Uber and Lyft collisions, motorcycle crashes on the 10, slip-and-fall injuries at hotels and restaurants, dog bites and wrongful death claims.

Our fee arrangement is a contingency: The Law Offices of Jacob Emrani (Call Jacob) charges nothing up front, and you pay nothing unless we win. A first consultation is free and carries no obligation. Clients laid up at Saint John’s, or at an apartment off Pico, can have a representative visit them, and our Spanish-language pages are at calljacob.com/es.

Two deadlines frame most Santa Monica cases. Against a commuter, tourist or rideshare driver, the lawsuit window is generally two years (CCP §335.1); against the city over a Big Blue Bus or a street defect, the six-month claim must come first. Different rules apply when the injured person is a child.

Our number for a Santa Monica car accident attorney is (888) 952-2952, and the online case evaluator is open around the clock.
