San Jose Personal Injury Lawyer: The First 72 Hours

San Jose recorded fewer traffic deaths in 2025 than in any year since 2012: 41 deaths, down from 49 the year before and from a peak of 63 in 2022. Half of the people killed, 20, were pedestrians. Yet through the middle of 2025, severe-injury crashes had not fallen at the same pace as deaths, according to San José Spotlight’s reporting on city data. Surviving a serious crash in a city of 989,814 people (U.S. Census Bureau) can mean months of treatment and a claim to build. What a San Jose personal injury lawyer can do later depends on what happened in the first 72 hours.

Before Anyone Leaves the Scene
The agency that responds determines where the report lives. A crash on Story Road or in a Willow Glen neighborhood gets a San Jose Police Department officer. A crash on a freeway ramp or mainline brings a California Highway Patrol officer from the San Jose Area office at 2020 Junction Avenue. Whichever badge you see, keep the officer’s card. The number handwritten on it is how the report gets ordered later.
Then, if you are able, take the photographs that matter most in San Jose crashes:
- Every vehicle’s final position, with lane lines and any crosswalk in frame
- Traffic signals facing each direction of travel
- The front and back of the other motorist’s registration and insurance card, photographed flat and clearly
- Storefronts and gas stations with cameras pointing at the street
- VTA riders at a nearby stop who watched the crash, with a phone number for each witness
Fleeing drivers are common enough to plan for. The 2023 state tally for San Jose counted 318 injury or fatal crashes where someone drove away (California Office of Traffic Safety). If the other car leaves, note the direction it went and any part of the plate, then report it right away. Your own uninsured motorist coverage can depend on that prompt report.
The First Night: Santa Clara Valley Medical Center, Regional, or a Smaller ER
Where Ambulances Go
Santa Clara Valley Medical Center has held Level I adult trauma status since 1986. It is also a Level II pediatric trauma center with burn, spinal cord, and brain injury programs. The county describes it as the only Level I trauma center in San Jose. Regional Medical Center in East San Jose, a Level II trauma center, has been operated by the county since April 1, 2025. The Santa Clara Valley Healthcare network lists its hospitals and services.
What the Chart Needs to Say
If paramedics take you to one of these hospitals, your injuries were serious enough to warrant a trauma evaluation, and those records will be central to the claim. If you drove yourself to urgent care, tell the provider exactly how the crash happened. The Next Morning: The Adjuster’s Call
Somewhere between breakfast and lunch on day two, a friendly adjuster may call about the Capitol Expressway or Senter Road intersection and ask for your story on tape. You are not required to give the other side a recorded statement. There is little upside in doing so before a doctor has told you what is wrong.
What to Say Instead
Give your name, confirm the date and location, and say you will be in touch once you have medical information. Do not guess at speeds or distances. Do not say, “I’m fine.”
What to Do with Your Own Insurer
Tell your own carrier promptly too, because the policy requires notice. If the other car turns out to carry no insurance, or the driver is never found, the claim may shift to your uninsured motorist coverage. The company you pay each month then becomes the one reviewing your injuries.

I Was Hit on Monterey Road. Does Its Reputation Help My Case?
Not directly, but it explains the road. Along the 9.6-mile stretch from Keyes Street to Metcalf Road, San José Spotlight reported 480 collisions, 42 deaths or severe injuries, and more than 350 minor injuries between 2019 and March 2022. It also reported four deaths at Monterey Road and Curtner Avenue between 2017 and 2021. A known history can support a claim about road design, which leads back to the six-month public-claim question.

Stepping outside the painted crosswalk does not automatically end a pedestrian claim. My Crash Was on Story Road Near Keyes Street. Is That a Flagged Corridor?
Yes. The Story Road–Keyes Street corridor was named among the city’s most dangerous and received $36.4 million in safety funding in 2023. Senter Road between Story Road and Monterey Road received a $10 million earmark.
Day 2: The Evidence San Jose Erases Fastest
Video is the most perishable evidence in a city this size. Many business systems record over footage within days. A friend or family member should visit the block around the crash on day two, list every camera, and ask managers in writing to preserve the relevant hour.
San Jose is also piloting 33 speed-safety cameras. The city chose the locations from 63 candidate sites on roads with histories of speed-related crashes, such as Berryessa Road. The program costs about $16 million, funded largely by federal grants. If your crash happened at or near one of those locations, ask whether recorded data exists and how to request it.

Day 3: Is a Public Agency Part of This?
On day three, step back and ask whether anyone besides the other driver played a role. A VTA bus or light-rail train, a county vehicle, a city truck, or a dangerous road condition may bring in a public agency. Any of those can require a written claim delivered to the agency within six months (California Government Code § 911.2). When a VTA bus is involved, that notice should be filed before the rest of the case is built. VTA’s route directory lists its bus and light-rail services.
This question is especially relevant on the corridors the city itself has flagged. In 2023, San Jose expanded its list of Priority Safety Corridors from 17 to 30. A $12.9 million federal Safe Streets and Roads for All award funded work on Curtner Avenue, Monterey Road at Curtner Avenue, Tully Road, Capitol Expressway at Senter Road, and East Santa Clara Street at 11th Street. The city has said most of those corridors run through Equity Priority Communities, where fatal and severe-injury rates are higher. The city’s Vision Zero program tracks this work.
After Day Three: The Long Part of the Claim
Since 2024, the city has run a multilingual “Slow Down, San Jose” campaign and used quick-build materials to reshape dangerous streets. For someone already hurt, however, the work becomes personal. Treatment continues, bills arrive, and the claim takes shape through medical costs, health-insurance liens, lost wages, future care, and pain and suffering.
Twenty of the city’s 41 traffic deaths in 2025 were pedestrians. Each death left a family entitled to consider a wrongful death claim, which has its own rules about who may sue.
If settlement talks stall, California generally allows two years from the crash date to file suit (California Code of Civil Procedure § 335.1). The complaint goes a few blocks from City Hall to the Downtown Superior Court at 191 North First Street (Santa Clara County Superior Court).
