The crash on Harvard Avenue

Harvard Avenue between Walnut Avenue and Irvine Center Drive is one of five hot spots identified in the city’s Local Roadway Safety Plan. The same plan found that right hooks, in which a turning driver cuts across a rider, accounted for nearly 40% of Irvine’s bicycle collisions (City of Irvine LRSP). Maya, in other words, was hurt in the most common type of Irvine bicycle crash, on a stretch of road the city had already flagged.

Dana cannot undo the crash, but what she does in the next ten minutes shapes the entire claim. She lets the paramedics decide whether Maya should go by ambulance rather than relying on a teenager’s assurance that she is fine. She photographs the sedan where it stopped, with the bike-lane stripe in the frame, because whether the driver crossed that stripe before or after Maya reached the driveway is the central fault question. She asks two other parents waiting at the curb whether they saw a turn signal and records their answers in her phone before leaving. She puts the broken e-bike and cracked helmet in her trunk without altering them.

Tip: Right-hook disputes usually turn on the turn signal and the mirror check. A witness who says “no signal” on the first day is far more valuable than a vague recollection six months later.

Because the crash happened on a city street, an Irvine police officer takes the report. If Maya had been on the shoulder near a freeway ramp at Jeffrey Road, the California Highway Patrol would likely have handled it instead.

Maya’s treatment in the emergency room

The ambulance takes Jamboree Road to UCI Health – Irvine, a 144-bed hospital with a 24-hour emergency department (UCI Health). Paramedics consider the severity of injury in choosing a destination. More serious injuries would have sent Maya to UCI Medical Center in Orange, which holds the county’s only Level I adult trauma designation as well as a Level II pediatric designation (UCI Health). CHOC is another possibility; its e-bike trauma cases rose from one in 2021 to 201 in 2025 (Voice of OC).

Maya leaves with a cast on a broken wrist and a concussion diagnosis. For the claim, the emergency room chart is the anchor document. It fixes the time, records that she was struck by a vehicle while riding and lists her injuries before anyone has a reason to dispute them. Concussion symptoms in teenagers can appear days later, so the follow-up visit the ER physician ordered matters as much as the ER visit itself. Obtaining the report and answering the adjuster

Two things reach Dana in the same week.

The first is a document she needs. The Irvine Police Department provides report copies free of charge, whether you use the online request form or visit the Business Desk at 1 Civic Center Plaza. If a detective must review a report before release, the department may take up to 10 days to decide, and hit-and-run reports must first be approved by a traffic investigator (Irvine PD Records). Both injured parties and the parents of injured minors may request a copy.

The second is a call she did not invite. An adjuster for the sedan’s carrier asks to interview Maya on tape. No family is obligated to put a concussed ninth-grader on a recorded line with the opposing insurer, and such interviews are often searched for phrases like “I was going kind of fast.”

Expect questions about the helmet and speed as well. Irvine Unified requires students to complete an e-bike safety course before riding to school (Voice of OC), and an adjuster may ask whether Maya took it, what class of e-bike she rode and how fast she was going. California applies pure comparative fault, so any percentage assigned to Maya reduces the award by that amount and no more (CACI 405).

Questions a parent asks at this stage

Is this an auto claim or a bicycle claim?

It is both. The sedan’s auto policy pays, just as it would if the sedan had struck another car, so an auto accident attorney in Irvine treats it like any vehicle case. Maya’s own conduct matters only to how fault is divided.

Maya never took the IUSD e-bike course. Does that end her case?

No. Skipping a school requirement did not cause the sedan to turn across the bike lane. It gives the insurer an argument, and at most it shifts some percentage of fault to Maya.

Was the driver required to report the crash to the DMV?

Yes. Fault does not matter here; the SR-1 is a reporting duty, and because the crash injured Maya the driver had 10 days to send it to the DMV. The same duty arises when damage exceeds $1,000 (California DMV). If you were driving in your own crash, that obligation is yours.

Does it help that Harvard Avenue is on the city’s list?

It helps frame the investigation. The hot-spot designation does not prove that this driver was careless, but it justifies requesting the city’s signal and design records near Walnut Avenue.

What if the crash had happened on the 405?

Then the CHP, not Irvine police, would write the report, and the family would request it from the CHP.

Documenting a 14-year-old’s damages

Maya completes treatment months later. By then, her claim rests on six categories of proof:

A minor’s settlement generally requires court approval before it becomes final, and the filing deadlines for injured children are calculated differently from those for adults. If Maya’s health plan paid her bills, it will want to be repaid from the settlement, and the amount it claims can be negotiated.

The demand and, if necessary, a lawsuit

When Maya’s doctors say she has reached maximum improvement, the family sends a settlement demand to the driver’s insurer. Most Irvine claims are resolved at this stage. In practice, the driver’s bodily injury liability limit sets a ceiling; if it is too low, the family’s own underinsured motorist coverage may provide a second source of recovery.

If the insurer will not make a fair offer, an Orange County personal injury attorney files suit in Orange County Superior Court. The courthouse for Irvine cases, limited and unlimited, is the Central Justice Center at 700 Civic Center Drive West in Santa Ana (OC Superior Court). Irvine’s June 2022 plan examined five years of injury crashes on city streets, from 2015 through 2019 (City of Irvine LRSP). Its findings closely match the circumstances of Maya’s afternoon:

Cyclists and pedestrians aged 19 and under appeared in those crashes far more often than their share of Irvine’s population would suggest.

The plan’s other hot spots are Roosevelt from Huntington to Sand Canyon Avenue, Campus Drive from University Drive to Turtle Rock Drive, Jeffrey Road from Portola Parkway to the Venta Spur Trail, and the intersection of Alton Parkway and Gateway.
